These Terms and Conditions govern your relationship with graceonik and use of our senior residence services. By engaging our services or using our website, you agree to these terms.

1. Definitions

In these Terms and Conditions:

  • "We," "Us," "Our" refers to graceonik
  • "Resident" refers to individuals residing at our facility
  • "Family Member" refers to authorized family members or representatives
  • "Services" refers to residence accommodation and associated care services
  • "Agreement" refers to the residence contract between parties
  • "Facility" refers to our senior residence location

2. Acceptance of Terms

By signing a residence agreement or using our services, you acknowledge that you:

  • Have read and understood these Terms and Conditions
  • Are at least 18 years of age
  • Have the legal capacity to enter into this agreement
  • Agree to comply with all facility policies and procedures

3. Services Provided

3.1 Residence Levels

We offer three residence levels: Pinecrest, Evergreen, and Timberline. Each level includes specific services as described in the residence agreement and our published materials.

3.2 Service Scope

Services may include:

  • Private accommodation
  • Meal services
  • Housekeeping and laundry
  • Activity programming
  • Personal assistance (varies by level)
  • Common area access

3.3 Service Availability

While we strive for consistent service delivery, availability may be affected by circumstances beyond our control, including staff illness, emergencies, or facility maintenance. We will make reasonable efforts to minimize service disruptions.

3.4 Not Medical Facility

graceonik is a residential community, not a medical facility. We do not provide medical treatment, nursing services, or specialized healthcare. Residents maintain relationships with their own healthcare providers.

4. Admission Requirements

Admission to graceonik requires:

  • Completion of application and assessment process
  • Signed residence agreement
  • Payment of applicable fees and deposits
  • Provision of required documentation (identification, emergency contacts, healthcare information)
  • Agreement to facility policies and procedures
  • Ability to live independently or with assistance available at selected residence level

We reserve the right to decline admission if we determine our facility cannot appropriately meet an individual's needs.

5. Payment Terms

5.1 Monthly Fees

Residence fees are billed monthly in advance. Payment is due by the first day of each month. Accepted payment methods include bank transfer and cheque.

5.2 Deposit

A refundable security deposit equivalent to one month's residence fee is required before move-in. This deposit will be returned within 30 days of move-out, minus any applicable deductions for damages or outstanding charges.

5.3 Late Payment

Late fees may apply for payments received after the 5th day of the month. Continued non-payment may result in service suspension or termination of residence agreement.

5.4 Fee Adjustments

We may adjust residence fees annually with 60 days written notice. Significant fee increases will be accompanied by explanation of contributing factors.

6. Resident Responsibilities

Residents and their representatives agree to:

  • Respect other residents, staff, and visitors
  • Comply with facility policies regarding conduct and safety
  • Maintain personal space in reasonable condition
  • Provide accurate health and emergency contact information
  • Notify staff of changes in health status or needs
  • Respect quiet hours and community standards
  • Pay fees on time
  • Give proper notice before moving out

7. Prohibited Activities

The following activities are prohibited:

  • Aggressive, threatening, or abusive behavior toward staff or other residents
  • Illegal activities or possession of prohibited substances
  • Smoking in non-designated areas
  • Unauthorized modifications to accommodations
  • Violation of other residents' privacy or safety
  • Excessive noise or disturbances

Violations may result in warnings, restrictions, or termination of residence agreement depending on severity.

8. Termination

8.1 Resident-Initiated Termination

Residents may terminate the agreement with 30 days written notice. Fees are prorated for partial months based on move-out date.

8.2 Facility-Initiated Termination

We may terminate the agreement with 30 days written notice if:

  • Resident's needs exceed what can be appropriately provided at selected level
  • Behavior poses safety risk to resident, staff, or other residents
  • Repeated policy violations occur
  • Non-payment continues after notice period

8.3 Immediate Termination

We reserve the right to immediate termination without notice in cases of serious safety violations, illegal activities, or severe misconduct.

9. Personal Property

Residents may bring personal belongings subject to space and safety considerations. We recommend:

  • Maintaining personal insurance for valuable items
  • Labeling personal belongings
  • Securing valuables
  • Avoiding prohibited items (weapons, hazardous materials)

While we take reasonable precautions, graceonik is not liable for loss, theft, or damage to personal property.

10. Privacy and Confidentiality

We maintain resident privacy in accordance with our Privacy Policy and Malaysian Personal Data Protection Act 2010. Personal and health information is shared only with:

  • Authorized family members designated by resident
  • Healthcare providers involved in care (with consent)
  • Staff members requiring information to perform duties
  • Authorities when legally required

11. Limitation of Liability

To the extent permitted by Malaysian law:

  • Services are provided on an "as is" basis
  • We make no guarantees regarding specific outcomes or results
  • We are not liable for health complications or medical issues
  • Our liability for service failures is limited to residence fee refunds for affected period
  • We are not liable for indirect, consequential, or incidental damages

This limitation does not affect liability for death or personal injury resulting from our negligence.

12. Indemnification

Residents and their representatives agree to indemnify graceonik against claims, damages, or expenses arising from violations of these terms, facility policies, or applicable law.

13. Dispute Resolution

13.1 Informal Resolution

We encourage addressing concerns through direct communication with management. Most issues can be resolved through discussion.

13.2 Governing Law

These terms are governed by the laws of Malaysia. Any disputes will be subject to the exclusive jurisdiction of Malaysian courts.

13.3 Mediation

Before pursuing legal action, parties agree to attempt mediation through a neutral third party.

14. General Provisions

14.1 Entire Agreement

These Terms and Conditions, together with the signed residence agreement and facility policies, constitute the entire agreement between parties.

14.2 Severability

If any provision is found invalid or unenforceable, remaining provisions continue in full effect.

14.3 Waiver

Failure to enforce any provision does not constitute waiver of that provision or our right to enforce it later.

14.4 Assignment

This agreement may not be transferred or assigned without our written consent.

15. Changes to Terms

We may update these Terms and Conditions with reasonable notice. Significant changes will be communicated through:

  • Written notice to residents and authorized family members
  • Posted notices in the facility
  • Website updates

Continued residence after changes take effect indicates acceptance of updated terms.
